1. Acceptance of these terms
These Terms of Service (“Terms”) apply to your use of the All Suffolk Brokerage website, its quote and contact forms, and our text message and email programs. “We,” “us,” and “our” mean All Suffolk Brokerage. “You” means the person using the website or communicating with us.
By using this website or submitting a form, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the website; you are always welcome to call our office instead.
These Terms cover the website and our communications. If you buy insurance, your relationship with the insurer is governed by your policy, and any separate written agreement you sign with us governs our brokerage services.
2. Eligibility
You must be at least 18 years old to submit a form or enroll in our text message programs. If you are requesting insurance for a driver under 18, such as a teen driver or learner permit holder, a parent or legal guardian should submit the request and provide the minor’s information.
3. No coverage until confirmed in writing
This website is not an insurance policy, and submitting a form does not bind, change, or cancel any coverage. Coverage is not in effect until it is confirmed in writing by the insurer or by the New York Automobile Insurance Plan.
- Information is general. Content on this website is general information about insurance. It is not a statement of the coverage you have or will receive.
- Quotes are estimates. Any quote, price range, or estimate we provide is based on the information you give us and is subject to underwriting, verification of your driving and claims records, eligibility rules, and final approval by the insurer or plan.
- Assigned-risk placement. Placement through the New York Automobile Insurance Plan (NYAIP) depends on the plan’s eligibility requirements and procedures. Premiums for plan policies are set under the plan’s approved rates, not by us, and the plan assigns the insurance company that issues the policy.
- No guarantees. We do not guarantee that any insurer or the plan will accept your application, that you will receive a particular price, or that you will save money.
- Your policy controls. Descriptions of coverage on this website are summaries. The actual terms, conditions, limits, and exclusions are stated in the policy documents, which control in any conflict.
- Not all products are available in all situations.
Do not cancel your current insurance until your new coverage is confirmed in writing. Driving without the insurance New York requires can lead to the suspension or revocation of your registration and driver license.
4. Our role & how we are paid
All Suffolk Brokerage is an insurance brokerage licensed in the State of New York. When we help you find coverage, we act as an insurance broker on your behalf: we gather your information, look for coverage options from the insurers and plans available to us, and submit applications for you. We do not issue policies, make underwriting decisions, or pay claims; the insurer or plan does.
Compensation disclosure. As New York Insurance Regulation 194 (11 NYCRR Part 30) requires, we want you to know how we are paid:
- We may receive compensation from the insurance company, the NYAIP servicing carrier, or another third party for the policies we place, usually as a commission based on a percentage of the premium.
- The amount of compensation may vary depending on the insurer, the product, the premium, and other factors, and in some cases may include additional amounts based on the overall volume or performance of business we place with an insurer.
- You may ask us for information about the compensation we expect to receive from the sale of a policy to you, and we will provide it.
- If we ever charge you a fee in addition to a commission, we will explain the fee and get your written agreement before you pay, as New York law requires.
5. Information you provide
You agree that the information you give us, on our forms, by phone, or in writing, is true, accurate, and complete to the best of your knowledge, and that you will tell us promptly if it changes. This includes information about all drivers in your household, vehicles, driving and claims history, property, business operations, and payroll.
Insurers rely on this information to decide whether to insure you and what to charge. Under New York Insurance Law § 3105, a material misrepresentation in an application can allow an insurer to rescind (cancel from the start) a policy or deny a claim. Leaving out a driver, a ticket, an accident, or a prior cancellation can have the same effect, and it can also change your price after the fact.
If you provide information about another person, you confirm that you are authorized to do so.
6. Insurance fraud warning
Insurance fraud is a crime in New York. Anyone who knowingly and with intent to defraud an insurance company or other person files an application for insurance or a claim that contains materially false information, or who hides information about a material fact in order to mislead, commits a fraudulent insurance act. That is a crime and can also lead to civil penalties.
Insurance applications and claim forms in New York include a formal fraud warning required by the New York Insurance Law. Licensed insurance professionals may be required to report suspected insurance fraud to the New York State Department of Financial Services.
7. No legal, tax, or financial advice
We are happy to explain coverage options and answer insurance questions, but nothing on this website is legal, tax, financial, or accounting advice. For questions about your legal obligations, taxes, or business structure, please consult a qualified professional. Choices about the coverage and limits you buy are yours to make.
8. Text messaging (SMS)
This section of our Terms of Service applies to text messages sent by All Suffolk Brokerage. We operate two separate text message programs. You may join either, both, or neither.
| Program | What you will receive | Frequency |
|---|---|---|
| All Suffolk Brokerage Customer Care & Updates | Customer care and quote-related messages, such as quote follow-ups, document requests, appointment and payment reminders, and policy updates | Message frequency varies based on your requests and account activity |
| All Suffolk Brokerage Marketing Messages | Marketing and promotional messages, such as renewal reviews and new coverage options; these may be sent using automated technology | Message frequency varies, up to 4 messages per month |
How to opt in
You can join a program by checking its box on one of our website forms. Each box is optional and unchecked by default. You can also opt in by giving us your consent verbally, such as on a call with our office, or in writing. Consent to receive text messages is not a condition of purchasing any product or service.
Costs
Message and data rates may apply, depending on your mobile plan. We do not charge for text messages.
How to opt out
Reply STOP to any message to opt out. We also accept STOPALL, UNSUBSCRIBE, CANCEL, END, and QUIT. After you opt out, you will receive one confirmation message, and then no further text messages from us at that number unless you opt in again. You may also opt out by telling us in any reasonable way, such as by calling us at (631) 906-7824 or emailing info@allsuffolkbrokerage.com. To opt back in, reply START or contact our office.
If you want to stop marketing texts but keep receiving customer care texts about an active quote or policy, contact our office and we will update your preferences. Opting out of texts does not cancel any insurance policy or stop service communications by phone, mail, or email.
Help
Reply HELP to any message for help, or contact us at (631) 906-7824 or info@allsuffolkbrokerage.com.
Carriers and devices
Our text programs are compatible with major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages. Message delivery depends on your carrier and device, and we are not responsible for delays or failures caused by them.
Your phone number
By opting in, you confirm that you are at least 18 years old and that you are the account holder of the mobile number you provided, or are authorized by the account holder to use it and to agree to these terms. If you change or give up that number, please tell us or reply STOP so that messages do not go to someone else.
Privacy
We will not share, sell, rent, or otherwise disclose your mobile phone number or SMS opt-in data and consent to any third parties or affiliates for their marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except with service providers (such as our SMS messaging platform) who help us deliver messages to you. See our Privacy Policy for how we handle text messaging information.
9. Phone calls & call recording
When you submit a form, you ask us to contact you by phone or email about your request, and we will use the number you provide to do that. We follow the federal Telephone Consumer Protection Act (TCPA). We will not make marketing calls using an autodialer or a prerecorded or artificial voice without your prior express written consent, and we honor the National Do Not Call Registry and our internal do-not-call list for marketing calls.
Call recording. Calls with our office may be recorded or monitored for quality, training, and record-keeping, including to keep an accurate record of what was said about your coverage. New York law allows a call to be recorded with the consent of one party to the call. If you are calling from, or we are calling you in, a place that requires the consent of everyone on the call, we will tell you before recording.
10. Email communications
We will email you about your requests, quotes, and policies. If you opt in, we may also send occasional emails about coverage reviews and renewals. You can unsubscribe from marketing emails at any time using the link in the email, and we will honor your request within 10 business days. Service emails about an active quote or policy are not marketing, and you will continue to receive them while that matter is open.
Regular email is not a fully secure way to send information. Please do not email Social Security numbers, driver license numbers, or payment card numbers.
11. Electronic communications & signatures
By using our website or communicating with us electronically, you agree that we may provide notices, disclosures, and other communications to you electronically, by email, text message (if you have opted in), or by posting them on this website, and that these satisfy any requirement that they be in writing. This consent is given under the federal Electronic Signatures in Global and National Commerce Act (E-SIGN) and the New York Electronic Signatures and Records Act.
- To receive electronic communications, you need an internet-connected device, a current web browser, an active email account, and the ability to open and save PDF files.
- You may ask for a free paper copy of any communication by contacting our office.
- You may withdraw your consent to electronic communications at any time by contacting us. Withdrawing consent does not affect communications already sent.
- Please keep your email address and phone number up to date with us.
Insurance companies may use their own process and consent forms for delivering policy documents and collecting electronic signatures, as permitted by New York Insurance Law. Those processes govern the documents they cover.
12. Intellectual property
The content of this website, including its text, graphics, logos, photographs, and design, is owned by All Suffolk Brokerage or used with permission, and is protected by copyright, trademark, and other laws. You may view and print pages for your personal, non-commercial use. You may not copy, republish, sell, or create derivative works from the content without our written permission. Insurer names and logos belong to their owners.
13. Acceptable use
When using our website, you agree not to:
- Submit false, misleading, or fraudulent information, or submit information about another person without authorization.
- Submit a form to sign someone else up for text messages or calls.
- Use automated tools to scrape, copy, or submit forms on the website, or attempt to overwhelm or interfere with it.
- Upload or transmit viruses or other harmful code, or try to gain unauthorized access to our systems.
- Use the website for any unlawful purpose.
14. Third-party links & services
Our website may link to, or display content from, other websites and services, such as insurers, government agencies, and Google. We provide these for convenience and are not responsible for their content, accuracy, or privacy practices.
15. Disclaimer of warranties
We work to keep this website accurate and available, but it is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties about the website and its content, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise that the website will be uninterrupted, error-free, or free of harmful components. Insurance rules, rates, and plan requirements change, so information on the website may not be current; please confirm details with our office.
This section applies to the website and its content. It does not limit any duty we owe you as your insurance broker under New York law, or any rights you have under your insurance policy.
16. Limitation of liability
To the extent permitted by New York law, All Suffolk Brokerage and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of, or inability to use, this website or its content. To the same extent, our total liability for any claim arising out of your use of the website is limited to one hundred dollars ($100).
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for gross negligence, willful misconduct, or fraud. These limits do not apply to our professional obligations when we place or service insurance for you, which are governed by New York law and any written agreement between us.
17. Indemnification
You agree to reimburse and defend All Suffolk Brokerage against third-party claims, losses, and reasonable costs, including reasonable attorneys’ fees, to the extent they result from your violation of these Terms, your misuse of the website, or information you knowingly submit that is false or that you were not authorized to provide. This does not apply to the extent a claim is caused by our own negligence or misconduct.
18. Governing law & venue
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules, and by applicable federal law. Any lawsuit about these Terms or the website must be brought in the state or federal courts located in Suffolk County, New York, and you and we consent to the jurisdiction of those courts. Nothing in this section prevents either of us from bringing an eligible claim in small claims court.
These Terms do not require arbitration, and they do not waive your right to bring or join a class action. You also have the right to contact the New York State Department of Financial Services at dfs.ny.gov with a complaint about an insurance company or insurance producer.
19. General terms
Severability
If any part of these Terms is found unenforceable, that part will be enforced to the maximum extent allowed, and the rest of these Terms will remain in effect.
Entire agreement
These Terms and our Privacy Policy are the entire agreement between you and us about your use of the website. They do not replace your insurance policy, any application you sign, or any separate written agreement with our office, which control on the matters they cover.
No waiver
If we do not enforce a part of these Terms right away, we have not given up the right to enforce it later.
Assignment
You may not transfer your rights under these Terms. We may transfer ours, for example if our business is sold or reorganized.
20. Changes to these terms
We may update these Terms from time to time. When we do, we will post the new version on this page and change the “Last updated” date. Changes apply from that date forward and do not apply to disputes that arose before the change. If we make a material change to our text messaging terms, we will tell program participants as required by applicable rules. Continuing to use the website after a change means you accept the updated Terms.
